Add another expletive to Fred Smith’s resume: COWARD.
Now that it is time that the Writ of Summons representing the wishes and determination of the good people of Smith’s Point settlement in East Grand Bahama is to be served on Fred Smith QC, process servers contend that Fred Smith has been ducking personal service of the Writ and is reported to be h iding out somewhere on a yacht at sea or in The Hamptons, Long Island, New York as a guest of Louis Bacon, the ugly American and enemy of the Bahamian people and their pristine environment.
By the Writ, the Plaintiffs are asking The Bahamas Supreme Court to force Fred Smith, the “Save the Bays” nuisance attorney to tear down the groyne he illegally built from his property and onto the seabed damaging the environment and charm of this historic community.
The historic Writ was filed by Fred Mather and Michael Grant, whose ancestry is well-established in Smith’s Point for more than 100 years.
It is important to note out that Fred Smith, who was born in Haiti, is in no way, shape or form connected ancestrally to Smith’s Point settlement. He has publicly bragged and claimed, although not tested in any Bahamian court of law, that his Bahamian citizenship comes purely out of an anomaly in the 1973 Constitution of The Bahamas.
Hailed as heroes in the community for their courage in facing down Fred Smith, Mather and Grant are promising to leave no stone unturned in their quest to bringing to justice, Fred Smith and his personally owned companies called Smith Point Limited and SeSaChe Limited, all Defendants in the case. The beach of Smith’s Point, once the most envied public beach in East Grand Bahama has been totally destroyed by Fred Smith’s wanton environmental breaches and terroristic interference.
More than 150 members of the community of Smith’s Point settlement which represents an overwhelming majority of the people, have signed a petition supporting this court action being taken against Fred Smith who they cons ider to be terroristic in his tactics to deprive them of the quiet enjoyment of their property and the environment. In fact, he has also used his huge dogs to intimidate residents from attempting to walk along the beach which he has now blocked-off.
The Writ has raised serious concerns about the duplicity of Fred Smith who has used Save the Bays (incorporated as Coalition to Protect Clifton Bay), a controversial organization created by the American Hedge Fund mogul, Louis Bacon, to gain political leverage in The Bahamas, to upstage the Government and bring other private development projects to a screeching halt which is believed is intended to influence the 2017 General Election.
The obvious irony in what Mather and Grant are accusing Fred Smith of doing is that which Fred Smith has been arrogantly and aggressively using Save The Bays to pursue Canadian Fashion Merchandising Titan and Designer, Peter Nygard by alleging without any proof whatsoever, that Nygard’s beloved home, Nygard Cay, is the fount of all environmental concerns on the coastline of Lyford Cay.
This Writ demonstrates that Fred Smith, if found culpable, is doing far worse at Smith’s Point, East Grand Bahama while misrepresenting verifiable the facts about Nygard and now reported to be engaged along with Louis Bacon and other nefarious characters, in the fabrication of information about Nygard and other upstanding citizens of The Bahamas.
In the legal fraternity in The Bahamas, it is sa id to be considered a serious breach of Silk, or status of a QC, to knowingly avoid personal service on himself by not presenting himself for service of Court documents.
Mather and Grant are expected to write the Bar Association and complain about Smith’s cowardly and improper conduct.
“He can run but he can’t h ide. There is no mountain, hill, cave or valley that he can escape to in Haiti to avoid his day of reckoning. The Bahamian people now get to see live, and in technicolor, how Fred Smith, Save and Bays and Louis Bacon are engaged in the most reprehensible abuse of the Bahamian environment while holding themselves out as being paragons of virtue,” a community leader in Smith Point said.
